Terms & Conditions

1 Our platform

Kiotrak helps businesses, service providers, organisations, schools, landlords, and other users create online business pages, share listings, receive customer requests, and connect with customers through WhatsApp.

Kiotrak is a platform that provides visibility and digital tools. Unless expressly stated otherwise, Kiotrak is not the seller, supplier, delivery provider, payment processor, employer, agent, or representative of businesses listed on the platform.

2 Eligibility and accounts

You must provide accurate, complete, and current information when creating an account or listing a business.

You are responsible for:

• Keeping your login details secure
• Ensuring that your business information is correct
• Updating your prices, availability, location, contacts, and listings
• Obtaining any licences, approvals, permissions, or registrations required for your business
• All activity carried out through your account

Kiotrak may suspend, edit, reject, or remove an account or listing that is false, misleading, unlawful, harmful, or contrary to these Terms.

3 Business listings and user content

You retain responsibility for the content you upload, including business names, descriptions, photos, products, services, prices, property listings, menus, school information, events, and contact details.

By uploading content, you give Kiotrak a non-exclusive right to display, reproduce, resize, and promote that content only for operating and marketing the platform.

You must not upload content that:

• Is false, misleading, fraudulent, or deceptive
• Infringes another person's rights, trademark, copyright, or privacy
• Promotes illegal goods, services, scams, hate, violence, or harmful content
• Contains malicious software or attempts to interfere with the platform
• Includes personal information you do not have permission to share

4 Customer transactions

Customers and listed businesses arrange their own communication, payment, delivery, booking, service provision, refunds, and dispute resolution directly.

Kiotrak does not guarantee the quality, safety, legality, availability, delivery, payment, or performance of products, services, properties, accommodation, transport, bookings, or other listings.

Users should exercise reasonable care before making payments, sharing personal information, visiting a property, booking a service, or entering into any transaction with another user.

5 WhatsApp and third-party platforms

Kiotrak may provide links that allow customers to contact a business through WhatsApp or other third-party platforms.

Your use of WhatsApp, social-media platforms, domain providers, hosting providers, payment providers, and other third-party services is also subject to their own terms and privacy policies. Kiotrak is not responsible for third-party platform availability, security, content, charges, or service changes.

6 Plans, free trials, and payment

Kiotrak may offer free trials, Starter plans, Premium plans, advertising packages, website services, domain and hosting assistance, POS/business-system services, and other services.

• A free trial lasts for the stated period, currently 7 days where offered.
• At the end of a free trial, you must choose and pay for an available plan to keep your business page active.
• Subscription fees, advertising fees, and service fees are payable in advance unless we agree otherwise in writing.
• Prices may change, but changes will not affect an already-paid active period.
• Failure to pay may result in suspension or removal of paid features or services.
• Unless otherwise agreed in writing, payments for completed digital services, subscription periods, advertising periods, domains, hosting, and third-party charges are non-refundable.

7 Advertising services

Advertising is optional and separate from your Kiotrak subscription.

Paid advertising may include featured placement, sponsored listings, promotional designs, or promotion through agreed Kiotrak channels. Advertisements will be identified as Featured or Sponsored where appropriate.

Advertising improves visibility but does not guarantee sales, orders, enquiries, bookings, followers, customers, or any specific business result.

Promotion periods do not renew automatically. When a paid advertising period ends, the business returns to a normal listing unless a new promotion package is purchased.

8 Domain, hosting, website, and business-support services

Kiotrak may provide domain, hosting, website-development, SEO, business-registration support, social-media setup, POS, and other business-support services.

For domain-name and hosting services:

• The client must provide accurate registration information.
• The client remains responsible for domain-renewal fees, hosting fees, and third-party charges.
• Where possible, the client should remain the registered owner of their domain name.
• Domain availability, registration, renewal, transfer, and hosting performance may depend on third-party providers.

For business-name or company-registration support:

• Kiotrak provides guidance and application-support services only.
• Kiotrak does not guarantee approval by the Business Registration Service, eCitizen, or any government authority.
• The client is responsible for confirming information, submitting required documents, and paying official government fees.

9 Privacy and data protection

We collect and process personal information only as needed to operate Kiotrak, provide services, communicate with users, process requests, improve the platform, and meet legal obligations.

Please read our Privacy Policy to understand how we collect, use, store, and protect personal information.

You must not use customer information obtained through Kiotrak for spam, scams, harassment, or unauthorised marketing.

10 Intellectual property

The Kiotrak name, logo, platform design, text, graphics, software, and other Kiotrak materials are owned by or licensed to Kiotrak Digital Ventures and may not be copied, modified, sold, or used without permission.

11 Suspension and termination

We may suspend or terminate access to Kiotrak where we reasonably believe that a user has violated these Terms, provided false information, failed to pay applicable fees, created risk for users or the platform, or engaged in unlawful conduct.

You may request account closure by contacting us. We may retain information where required for legal, security, accounting, or dispute-resolution purposes.

12 Limitation of liability

To the extent permitted by law, Kiotrak is not liable for indirect, incidental, special, consequential, or business losses arising from your use of the platform or dealings with other users.

Kiotrak's total liability for a paid service will not exceed the amount you paid to Kiotrak for that specific service during the three months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

13 Changes to these terms

We may update these Terms from time to time. The latest version will be published on this page with an updated date. Continued use of Kiotrak after an update means that you accept the revised Terms.

14 Governing law

These Terms are governed by the laws of Kenya. Any dispute relating to these Terms or use of Kiotrak will be handled under the applicable laws and courts of Kenya.
